RTK Motion — Data Licensing Terms

1. Scope

These Data Licensing Terms ("Terms") govern the purchase and use of data products sold through the RTK Motion marketplace at api.rtkmotion.io. By purchasing or accessing data through MCP tools, x402 HTTP payment, or any other access method, you ("Buyer") agree to these Terms. RTK Motion is operated by RealTime Kinetics, LLC ("RTK," "we," "us").

2. Data Products

RTK Motion sells structured data across three verticals:

• Motion Capture — BVH skeletal animation, 3D keypoints, video, and robot-ready joint trajectories from 4D volumetric capture sessions.
• Rehabilitation Biomechanics — Clinical biomechanical reports derived from markerless motion capture of rehabilitation exercises. Includes per-exercise and cross-exercise analyses with joint load, asymmetry, ROM, and fatigue metrics.
• Threat Intelligence — Continuously updated location threat assessments generated by automated OSINT collection and sensor fusion. Confidence-scored with enriched entities and temporal context.

3. License Grant

Upon verified payment, RTK grants Buyer a non-exclusive, non-transferable license to use the purchased data product for Buyer's internal purposes, including:

• Machine learning model training and evaluation
• Scientific research and publication (with attribution)
• Clinical validation and quality assurance
• Risk assessment and underwriting
• Robotics simulation and kinematic retargeting

Buyer may not resell, sublicense, or redistribute the raw data. Derivative works (trained models, published analyses, internal reports) are Buyer's property.

4. Payment

All payments are made in USDC stablecoin on supported blockchain networks (Base L2, Ethereum, Solana). Payment is verified on-chain before data is delivered. Two payment flows are supported:

• MCP Tool Flow — Buyer's agent calls an MCP tool, sends USDC, and retries the tool call with the transaction hash.
• x402 HTTP Flow — Buyer's agent receives HTTP 402 with pricing, sends USDC, and retries the request with an X-PAYMENT header containing the transaction hash.

Prices are listed at api.rtkmotion.io/pricing and are subject to change. The price at the time of purchase governs.

5. Provenance and Verification

Every paid data delivery includes a cryptographically signed license with:

• Content SHA-256 hash for integrity verification
• ECDSA P-256 provenance signature verifiable at /.well-known/jwks.json
• Chain of custody from capture through delivery
• Payment transaction reference

Buyer may verify any license at api.rtkmotion.io/verify.

6. De-Identification of Rehabilitation Data

Rehabilitation biomechanics data is derived from consented clinical motion capture sessions. Before sale, all records are de-identified consistent with the HIPAA Safe Harbor standard:

• Patient wallet addresses and identifiers are removed
• Records are identified only by an opaque, non-reversible subject identifier
• Demographic fields (age, sex) are retained for clinical relevance

Buyer agrees not to attempt to re-identify any data subject.

7. Threat Intelligence Disclaimer

Threat assessments are generated by automated systems from public data sources. They are not verified by law enforcement and do not constitute professional security advice. Threat levels, confidence scores, and predictions are probabilistic estimates, not guarantees. Buyer assumes all risk from decisions made based on threat data.

8. Free Samples

RTK Motion provides free sample data for each vertical (truncated motion capture, redacted rehab summaries, live threat level snapshots). Samples are provided for evaluation purposes and are subject to these same Terms. No payment is required for samples.

9. Disclaimer of Warranties

DATA PRODUCTS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT. REALTIME KINETICS, LLC DOES NOT WARRANT THAT DATA WILL BE ERROR-FREE, THAT THREAT ASSESSMENTS WILL BE ACCURATE, OR THAT BIOMECHANICAL ANALYSES WILL BE CLINICALLY VALID FOR ANY PARTICULAR USE.

10. Limitation of Liability

To the maximum extent permitted by law, RealTime Kinetics, LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the purchase or use of data products, including but not limited to:

• Decisions made based on threat intelligence data
• Clinical or medical decisions informed by biomechanical reports
• Failures in robotic systems trained on motion capture data
• Loss of revenue from data product inaccuracies

In no event shall RealTime Kinetics, LLC's total aggregate liability exceed the amount Buyer paid for the specific data product giving rise to the claim.

11. Indemnification

Buyer agrees to indemnify, defend, and hold harmless RealTime Kinetics, LLC from any claims, losses, or liabilities arising from: (a) Buyer's use of purchased data; (b) Buyer's violation of these Terms; (c) any attempt to re-identify de-identified data subjects; or (d) Buyer's downstream distribution of data in violation of the license grant.

12. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any dispute shall be resolved in the state or federal courts located in Virginia.

Overview

RealTime Kinetics, LLC ("RTK," "we," "us") operates two products: RTK Motion (a data marketplace at rtkmotion.io) and RTKHealth (a health tracking application at healthbuddy.rtkmotion.io). This Privacy Policy describes how we collect, use, and protect data across all products and services.

Data Controller

RealTime Kinetics, LLC is the data controller for all data processed through RTK Motion and RTKHealth.

What We Collect — By Product

RTK Motion (Data Marketplace)

• Buyer wallet addresses — recorded in license objects when purchases are made
• Transaction hashes — on-chain payment references for verification
• Request logs — IP address, user agent, requested paths (retained for security and analytics; not linked to identity)

We do not require accounts, email addresses, or personal information to purchase data via MCP or x402.

RTKHealth (Health Tracking)

See the RTKHealth Privacy Policy for complete details. In summary: wallet address (pseudonymous identifier), health profile, diary logs, uploaded files, connected tracker data, AI analysis results, and optional email for weekly summaries.

How We Use Data

• Service delivery — providing the features of each product
• Payment verification — on-chain transaction verification for data purchases
• Research and licensing — de-identified health data may be used for longitudinal research and commercially licensed as described in the RTKHealth Terms of Service
• Aggregate analytics — anonymized traffic and usage patterns to improve our services
• Security — detecting and preventing unauthorized access

What We Do NOT Do

• Sell or share data that identifies any individual
• Link wallet addresses to real-world identities
• Use tracking cookies or advertising identifiers
• Share data with advertisers or data brokers
• Use email addresses for marketing (email is used only for opted-in weekly health summaries via RTKHealth)

Data Retention

• RTKHealth — data retained for the life of the account. Deletion within 30 days of request. Backups purged within 90 days.
• RTK Motion — purchase records (license objects, transaction hashes) retained indefinitely for provenance verification. Request logs retained for 90 days.
• De-identified data — data that has been incorporated into research datasets or derivative products prior to a deletion request may be retained, as it cannot be traced to any individual.

Your Rights

All Users

• Access — view your data through the applicable product interface
• Deletion — request deletion by contacting us
• Withdraw consent — stop using the service and request deletion at any time

EEA/GDPR Users

In addition: rectification, restriction of processing, data portability, objection to processing, and the right to lodge a complaint with your local data protection authority. Lawful basis: explicit consent (wallet connection) and legitimate interest (service provision). Wallet addresses are pseudonymous personal data under GDPR.

HIPAA

RealTime Kinetics, LLC is not a HIPAA-covered entity. We voluntarily follow HIPAA principles where applicable, including minimum-necessary access and de-identification consistent with the HIPAA Safe Harbor standard before any research or commercial use of health data.

Children's Privacy

Our products are not intended for individuals under 18. We do not knowingly collect data from minors.

Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated through the applicable product interface and noted by updating the "Last Updated" date above.

Governing Law

This Privacy Policy is governed by the laws of the Commonwealth of Virginia.
